About the Federal and Illinois Appeals Process

The appellate process in both the federal and Illinois court systems involves reviewing decisions from lower courts. In federal appeals, the United States Court of Appeals, which consists of thirteen circuits (including the Federal Circuit), handles cases from district courts.

On the other hand, the appellate court system in Illinois consists of five districts.

  • The First District in Chicago
  • The Second District in Elgin
  • The Third District in Ottawa
  • The Fourth District in Springfield
  • The Fifth District in Mount Vernon

Each district reviews decisions made by the trial courts located within its jurisdiction.

Appellate courts consider the arguments presented in written briefs and may also schedule oral arguments. The appellate court’s decision can affirm, reverse, or modify the lower court’s judgment, or it may remand (send) the case back to the trial court for further proceedings.
